KITCHENAID x LANEIGE – OCTOBER 2025 INSTAGRAM GIVEAWAY TERMS AND CONDITIONS
1. Information on how to enter this Promotion and Prize details form part of these Terms and Conditions of entry (Terms). These Terms apply to the Promotion and entry into the Promotion is deemed acceptance of these Terms.
2. The promoter is AMOREPACIFIC AUSTRALIA (ABN 37 622 347 237) of Suite 501 - Level 5, 459 Little Collins Street, Melbourne, telephone +61 451 127 200 (Laneige, the Promoter). Under this Promotion, KitchenAid Australia (ABN 50 601 363 419) of .01, 50 Carrington Street, Sydney, Australia, telephone (02) 4902 6500 (KitchenAid) will supply the KitchenAid components of the Prize.[JR1] [JR2]
Promotion entry details
3. The Promotion will be open from 9:00 am AEDT on Wednesday, 8th October 2025 and will close at 11:59 pm AEDT on Sunday 12th October 2025 (Promotion Period). Entries received outside the Promotion Period are invalid.
4. Entry is open to Australian & New Zealand residents aged 18 years or over, excluding management, directors, employees or contractors of the Promoter (or any of their business partners) and retailers, suppliers, agencies and companies associated with the Promotion, and their immediate families (Eligible Entrants).
5. By entering this Promotion you represent that you are eligible to enter.
6. To enter the Promotion and be eligible to win, Eligible Entrants must, during the Promotion Period:
a. like the promotional post the subject of this Promotion (the Promotional Post), which will be posted on both the Promoter’s Instagram account (@laneige_anz) and KitchenAid ANZ's Instagram account (@kitchenaidausnz); and
b. follow (or, already be following) both the Promoter’s Instagram account @laneige_anz, located at https://www.instagram.com/laneige_anz/, and KitchenAid ANZ’s Instagram account @kitchenaidausnz, located at https://www.instagram.com/kitchenaidausnz/, and remain following until at least the date of the Draw; and
c. tag a friend in the comments section of the Promotional Post and comment what they’re going to be baking;
d. (Eligible Entry).
7. There is no limit on the amount of times Eligible Entrants can enter the Promotion, but each new Eligible Entry must involve a new comment and tagging a friend.
8. Eligible Entrants will be automatically entered into the Promotion upon submitting an Eligible Entry (assuming that the Eligible Entrants have complied with these Terms and are not otherwise disqualified or their entry is invalid).
9. Any entry that does not comply with these Terms is not an Eligible Entry. Entries will be deemed invalid if:
- they are incomplete, illegible, incorrect, or incomprehensible;
- they are, or contain, forged, fraudulent, misleading, deceptive, or dishonest information;
- the entries have been tampered or interfered with in any way, including by use of any automated entry software; and/or
- the entry contains offensive or defamatory comments, or which breaches any law or infringes any third party rights (including intellectual property rights).
10. The Promoter reserves the right (in its sole discretion) to contact an Eligible Entrant to seek to resolve any issues with an incomplete or otherwise deficient entry that are capable of resolution. If, following contact with the Eligible Entrant, such issues are resolved by the Eligible Entrant to the satisfaction of the Promoter, the Promoter may accept the updated application as an Eligible Entry.
11. The Promoter accepts no responsibility for any entries that are not received for any reason during the Promotion Period, including by reason of being lost, late or misdirected. The Promoter is not re-sponsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
Prize details
12. This is a game of chance, not skill. The draw (Draw) will take place at the Promoter's premises at 9:00 am AEDT on Monday, 13th October, 2025. A representative of the Promoter will use a random generator to randomly select the winner and then verify that it is an Eligible Entry. If the winner’s entry is not an Eligible Entry, the Draw will take place again until a winner whose entry is an Eligible Entry is randomly selected using the random generator (Prize Winner).
13. There is one (1) prize on offer in total as part of the Promotion (Prize). The Prize Winner will win the Prize. The Prize consists of each of the following items:
a. Provided and delivered by Laneige ANZ:
i. 1 x Lip Sleeping Mask in Strawberry Shortcake (AUD 33)
ii. 1 x Lip Glowy Balm Vanilla (AUD 28)
iii. 1 x Lip Glowy Balm Sweet Candy (AUD 28)
iv. 1 x Water Bank Cream (AUD 57)
v. 1 x Cream Skin Mist (AUD 16)
vi. 1 x Water Sleeping Mask (AUD 48)
vii. 1 x Cica Sleeping Mask (AUD 49)
viii. 1 x Bouncy & Firm Sleeping Mask (AUD 55)
b. Provided and delivered by KitchenAid ANZ:
i. 1 x Artisan Tilt-Head Stand Mixer KSM192 (AUD 799)
14. The total value of the Prize is AUD 1,113.
15. In the event that the Promoter is unable to supply the Prize, or any part thereof, the Promoter reserves the right to supply an alternative prize of similar monetary value.
16. The Prize will be dispatched at the Promoter's cost to the Prize Winner's nominated address (which must be a valid Australian or New Zealand address) within 28 days of the date of the Draw (or, any subsequent Re-Draw). The Prize may be dispatched and delivered to the Prize Winner in separate deliveries. All other costs associated with the Prize are the responsibility of the Prize Winner. The Promoter will not be liable for any loss or damage to the Prize caused by its delivery to the nominated address.
17. The Prize is not transferable and cannot be exchanged for cash. The Promoter accepts no responsibility for any variation in the value of the Prize, or any part thereof, or for any tax liabilities that may arise from winning a Prize.
18. The Prize Winner will be notified by the Promoter via direct message to the Instagram account used to comment on the Promotional Post, within seven (7) days of the date of the Draw. The Prize Winner must nominate the colour of the KitchenAid Artisan Tilt-Head Stand Mixer KSM192, and an Australian or New Zealand address to which the Prize will be sent.
19. The Promoter reserves the right to request that the Prize Winner provide proof of their identity, residency and age prior to awarding the Prize. Proof of identification considered suitable for verification is at the discretion of the Promoter. In the event that the Prize Winner cannot provide suitable proof, in the timeframe required by the Promoter, that Prize Winner will forfeit the Prize and no substitute will be offered.
20. If the Promoter is unable to contact the Prize Winner to claim a Prize within 7 days of providing notification in accordance with clause 18, or the Prize Winner cannot provide suitable proof as required by clause 19 or is otherwise unable to accept the Prize, the Prize will be deemed as forfeited. It is the responsibility of all entrants to check their Instagram inbox to ensure that they receive any communications relating to the Promotion.
21. Where the Prize Winner has forfeited the Prize, or if for any other reason a re-draw is required in accordance with these Terms, the representative of the Promoter will choose a replacement Prize Winner in accordance with clause 12(Re-Draw). Laneige ANZ will notify the winner of the Re-Draw in accordance with clause 18. If the winner of the Re-Draw is unable to be contacted despite the Promoter's reasonable efforts, subsequent re-draws will take place in the same manner until the Prize is claimed by the winner of the latest re-draw.
22. The Instagram account of the Prize Winner will be announced by the Promoter and KitchenAid via Instagram Stories on the Promoter's Instagram account 10am AEDT on Monday 13th October 2025.
23. The Promoter's decision is final on all matters and no correspondence will be entered into.
Other Terms
24. Eligible Entrants agree and acknowledge that all entries become and remain the property of the Promoter upon entry. The Promoter reserves the right to use any entry for any purpose in connection with the Promotion and the goods of the Promoter.
25. The Promoter collects personal information about entrants to include entrants in the Promotion and where appropriate award a Prize. By participating in the Promotion, each entrant consents to disclosing their personal information to the Promoter and the Promoter using, and disclosing their personal information to the relevant authorities in the relevant States, the Promoter's related entities, the Promoter's agencies and other third parties engaged to provide services in connection with the Promotion (including, KitchenAid) for the following purposes:
(a) conducting the Promotion;
(b) contacting the entrant in relation to the Promotion;
26. Entrants provide this consent until such a time as they withdraw their consent by giving notice to the Promoter. Entrants can also gain access to, update or correct any personal information held by contacting the Promoter at the details listed in clause 2 of these Terms.
27. The Promoter will not be liable for any loss or damage whatsoever (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained in connection with this Promotion or as a result of accepting or using the Prize, except for any liability which cannot be excluded by law.
28. Nothing in these Terms limits, excludes or modifies, or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Consumer Law or similar consumer protection laws in Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion including, but not limited to, where arising out of the following:
- any technical difficulties or product malfunction (whether or not under the Promoter's control);
- any theft, unauthorised access or third party interference;
- any entry that is late, lost, altered, damaged or misdirected (whether or not after the receipt by the Promoter) due to interference;
- any tax liability incurred by a claimant; or
- the Prize or use of the Prize.
29. If the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from any applicable regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
30. If you have any dispute or complaint relating to the Promotion, please contact the Promoter at the details listed in clause 2 of these Terms. The Promoter will use their reasonable endeavours to respond to you within 21 business days to discuss a resolution in good faith.
31. You acknowledge that the Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram. You release Instagram from all claims that you may have against Instagram arising out of or in connection with this Promotion.
32. These Terms are governed by the laws of New South Wales. Eligible Entrants submit to the non-exclusive jurisdiction of the courts of New South Wales.
33. The Promoter may change these Terms from time to time by posting the revised Terms (or a link to them) on the Promoter's website. Eligible Claimants should regularly check the Promoter's website for update.
