KitchenAid Australia Espresso Coffee Christmas Gift With Purchase Promotion 2024

1. Information on how to purchase Participating Products and how to receive a Gift forms part of these Terms and Conditions (Terms). These Terms apply to the KitchenAid Australia Espresso Coffee Christmas Gift With Purchase Promotion 2024 (Promotion) and submission of a claim to redeem a Gift is deemed acceptance of these Terms and Conditions.

2. The promoter is KitchenAid Australia Pty Ltd (ABN 50 601 363 419) of 6-8 Billbrooke Close, Cameron Park NSW 2285, Australia, telephone (02) 4902 6500 (Promoter).

Definitions

3. For the purposes of these Terms and Conditions:

a. Participating Product(s) refers to the Tier One Participating Product and/or the Tier Two Participating Product(s). The Participating Products are subject to stock availability.

b. Tier One Participating Product refers to the KitchenAid Semi Automatic Espresso Machine with Burr Grinder, model number KES6551 (RRP $999)

c. Tier Two Participating Product(s) refers to any of the following:

i. KitchenAid Fully Automatic Espresso Machine KF6, model number KES8556 (RRP $1,799);
ii. KitchenAid Fully Automatic Espresso Machine KF7, model number KES8557 (RRP $2,199); or
iii. KitchenAid Fully Automatic Espresso Machine KF8, model number KES8558 (RRP $2,599).

d. Gift refers to the Tier One Gift and/or the Tier Two Gift, as applicable.

e. Tier One Gift refers to:

i. Golden Brown roasted coffee beans 1kg (RRP $60);
ii. KitchenAid Double Wall Latte Glasses x 2 (RRP $40); and
iii. 40 minute Live Virtual Espresso Masterclass with Bel (RRP $100).

f. Tier Two Gift refers to:

i. Golden Brown roasted coffee beans 3x1kg monthly deliveries (RRP $180);
ii. KitchenAid Double Wall Latte Glasses x 4 (RRP $80); and
iii. 40 minute Live Virtual Espresso Masterclass with Bel (RRP $100).

Promotion entry details

4. The Promotion will be open from 9:00am AEDT on Friday 1 November 2024 and will close on 11:59pm AEDT on Tuesday 31 December 2024 (Promotion Period). Purchases made outside the Promotion Period are not subject to this Promotion.

5. Entry is open to Australian residents aged 18 years and over (Eligible Claimants).

6. Employees, directors, management and contractors of the Promoter and other agencies, firms, retail staff or companies associated with the Promotion, and their immediate families, are not eligible to enter. By entering this Promotion you represent that you are eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

How to enter the Promotion

7. To enter the Promotion and be eligible for the Gift, the Eligible Claimant must, during the Promotion Period, purchase a Participating Product online at kitchenaid.com.au (Website) or in store or online from a Participating Retail Partner.

8. Eligible Claimants who purchase a Tier One Participating Product will be eligible for the Tier One Gift. Eligible Claimants who purchase a Tier Two Participating Product will be eligible for the Tier Two Gift.

9. (Website) When purchasing a Participating Product from the Website,

Eligible Claimant must follow the following steps in order to receive the Gift:

a. Complete the purchase of the Participating Product on the Website during the Promotion Period and opt in to receive updates and marketing communications from the Promoter at checkout (by ticking the applicable box at check out). The Eligible Claimant will then receive an order confirmation email from the Promoter (Order Confirmation Email);

b. If the the Eligible Claimant has correctly opted in to receive updates and marketing communications from the Promoter per clause 9(a) above, the Eligible Claimant will receive a email confirmation within 2 Business Days containing:

i. a discount code to redeem the Golden Brown roasted coffee beans from the Golden Brown Coffee website https://goldenbrown.coffee/; and

ii. an Eventbrite link to book the 40 minute Live Virtual Espresso Masterclass with Bel.

(the Gift Email).

d. It is the Eligible Claimant's responsibility to redeem the Golden Brown roasted coffee beans before the expiry of the discount code (being, Wednesday, 30th April 2025) and book the 40 minute Live Virtual Espresso Masterclass with Bel (which is only available from Monday, 18th November 2024 to Friday, 28th February 2025 and must be redeemed during this period). The Promoter is not responsible if the Eligible Claimant fails to do so or loses the Gift Email.

e. The Promoter will deliver the KitchenAid Double Wall Latte Glasses to the Eligible Claimant following the Eligible Claimant’s purchase of the Participating Product on the Website.

10. (Participating Retail Provider) When purchasing a Participating Product in store or online from a Participating Retail Partner, the Eligible Claimant must follow the following steps in order to receive the Gift:

a. Complete the purchase of the Participating Product in store or online from a Participating Retail Partner during the Promotion Period.

b. Access the Registration Form via the Website at https://kitchenaid.com.au/pages/register-my-product and complete the requested details, including the Eligible Claimant's name, email, phone and delivery address, product model number, colour, serial number and purchase date by 11:59pm, Friday 31 January 2025. In order to complete the Registration Form and be eligible to receive the Gift, the Eligible Claimant must opt in updates and marketing communications from the Promoter (by ticking the applicable box in the Registration Form);

c. If the Registration Form has been correctly completed by the Eligible Claimant, the Eligible Claimant will receive a Gift Email within 2 Business Days. For completeness, the Gift Email will contain:

i. a discount code to redeem the Golden Brown roasted coffee beans from the Golden Brown Coffee website https://goldenbrown.coffee/; and
ii. an Eventbrite link to book the 40 minute Live Virtual Espresso Masterclass with Bel.

d. It is the Eligible Claimant's responsibility to redeem the Golden Brown roasted coffee beans before the expiry of the discount code (being, Wednesday, 30th April 2025) and book the 40 minute Live Virtual Espresso Masterclass with Bel (which is only available from [Monday, 18th November 2024] to Friday, 28th February 2025 and must be redeemed during this period). The Promoter is not responsible if the Eligible Claimant fails to do so or loses the Gift Email.

e. The Promoter will deliver the KitchenAid Double Wall Latte Glasses to the Eligible Claimant's delivery address provided in the Registration Form.

11. Participating Retail Partners are:

a. JB Hi-Fi Limited;
b. The Good Guys;
c. David Jones Limited;
d. Kitchen Warehouse Pty Ltd
e. Minimax Pty Ltd; and
f. Myer Holdings Limited

12. A maximum of one (1) Gift can be redeemed per person.

13. The Promoter reserves the right to disqualify Eligible Claimants if proof of age or identity has not been provided, or the Eligible Claimant has not otherwise complied with these Terms. The Promoter's decision is final on all matters and no correspondence will be entered into.

14. The Promotion is not available in conjunction with any other promotion, offer or discount unless otherwise specified.

Participating Product and Gift details

15. Commercial sales, second-hand purchases, refurbished products, trade seconds products, insurance claims, purchases denoted “Clearance” (including seconds) or special offers are excluded from this Promotion, and any Participating Products purchased in these ways will not be eligible for this Promotion or the Gift.

16. Should the Gift or any part of the Gift become out of stock, the Promoter reserves the right to provide an alternative item of the same or higher retail value. The Gift is not transferable or exchangeable by the Eligible Claimant. All other costs associated with the Gift are the responsibility of the Eligible Claimant.

17. The Eligible Claimant shall accept the Gift as described in these Terms and acknowledges that the Promoter accepts no responsibility for any variation in value, or for any tax liabilities that may arise from claiming the Gift. The Recommended Retail Price (RRP) includes GST and is suggested only.

18. Any costs incurred by the Eligible Claimant associated with this Promotion including making telephone enquiries in relation to the Gift are the sole responsibility of the Eligible Claimant.

Other Terms

19. Nothing in these Terms limits, excludes or modifies, or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law, as well as any other implied warranties under the Australian Consumer Law or similar consumer protection laws in Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion including, but not limited to, where arising out of the following: a. any technical difficulties or product malfunction (whether or not under the Promoter's control); b. any theft, unauthorised access or third party interference; c. any claim that is late, lost, altered, damaged or misdirected (whether or not after the receipt by the Promoter) due to interference; d. any tax liability incurred by a claimant; or e. use of the Gift, except to the extent that such liability arises as a result of the Promoter's own error, omission or negligence.

20. The Promoter collects personal information ("PI") disclosed by an Eligible Claimant in order to conduct the Promotion and otherwise for the purposes set out in this clause ‎17, and may, for these purposes, disclose an Eligible Claimant’s PI to third parties, including but not limited to the Promoter’s agents, contractors and service providers. The purchase of a Participating Product and claim for a Gift is conditional on that Eligible Claimant providing this PI. In addition to any uses that may be outlined in the Promoter's Privacy Policies, if the Eligible Claimant opts-in by ticking the opt-in box at the time of submitting their claim, that Eligible Claimant consents to the information they submit being entered into a database of the Promoter and its agents and for this information to be used, unless otherwise advised, for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. All personal details of the Eligible Claimant will be stored by the Promoter and its agents and are subject to the Promoter’s Privacy Policy, see https://kitchenaid.com.au/pages/privacy-policy. A request to opt out, access, update or correct any information can be made by contacting the Promoter. Unless otherwise indicated by the Promoter or its agent, the Promoter or its agent may disclose PI overseas.
