KITCHENAID AUSTRALIA – EXCLUSIVE D2C OFFER (FEBRUARY 2025)
TERMS AND CONDITIONS
- These terms and conditions apply to the offer whereby customers who purchases at least two (2)
Eligible Items on the Website during the Offer Period will receive a 15% discount off of the total
combined value of all Eligible Items purchased (Offer).
2. Information on how to qualify for the Offer forms part of these Terms and Conditions (Terms).
These Terms apply to the Offer and redeeming the Offer is deemed acceptance of these Terms.
3. The promoter is KitchenAid Australia Pty Ltd (ABN 50 601 363 419) of 6-8 Billbrooke Close
Cameron Park NSW 2286, Australia, telephone (02) 4902 6500 (Promoter).
Definitions
4. For the purposes of these Terms:
a. Eligible Item refers to a product that is in stock and available for Purchase (including pre-
order) on the Website during the Offer Period and that is advertised for Purchase at a price
greater than AUD 100.00. Eligible Items include products which are already subject to a
discount during the Offer Period, but exclude the following products:
i. Semi Automatic Espresso Machine with Burr Grinder;
ii. KF6 Fully Automatic Espresso Machine;
iii. KF7 Fully Automatic Espresso Machine;
iv. KF8 Fully Automatic Espresso Machine; and
v. all "Bundle" products (which are promoted for sale and labelled on the
Website as "Bundle and Save"
b. Purchase means making full and final payment for a Eligible Item, including by use
services such as Afterpay and Zippay.
c. Website means the KitchenAid Australian website at kitchenaid.com.au.
Offer details
5. The Offer will be open from 12:01:00 AM (AEDT) Friday, 21 February 2025 and will close at 11:59 PM (AEDT) Sunday, 2 March 2025 (Offer Period).
6. Entry is open to Australian residents aged 18 years or over (Eligible Claimant).
Qualifying for the Offer
7. To qualify for the Offer, an Eligible Claimant must, during the Offer Period, Purchase at least two
(2) Eligible Items from the Website in a single transaction. To complete their Purchase, the Eligible Claimant must add the Eligible Items to their cart.
8. The Offer will automatically be applied at the Website checkout, subject to the requirements of clause 7 above being satisfied.
9. The Offer will be applied such that the Eligible Claimant will receive a 15% discount off of the total combined value of all Eligible Items Purchased in the transaction. The 15% discount does not apply to products that are not Eligible Items.
10. The Offer is not transferable and cannot be exchanged for cash. The Promoter accepts no responsibility for any tax liabilities that may arise from claiming or redeeming the Offer.
11. Commercial sales, second-hand purchases, refurbished products, trade seconds products, insurance claims, purchases denoted “Clearance” (including seconds) or special offers do not qualify for the Offer.
12. The Offer is not available in conjunction with any existing orders made outside of the Offer Period, nor in conjunction with the Espresso Gift with Purchase promotion or any Bundle products.
13. The Promoter reserves the right to disqualify Eligible Claimants if proof of age or identity has not been provided, or the Eligible Claimant has not otherwise complied with these Terms. The Promoter's decision is final on all matters and no correspondence will be entered into Other terms
14. Any costs incurred by the Eligible Claimant associated with this Offer including making telephone enquiries in relation to the Offer are the sole responsibility of the Eligible Claimant.
15. If you cancel or return any of your Eligible Items, the Promoter will only refund the price actually paid for those Eligible Items (taking into account any 15% discount that may have been applied), subject to applicable refund policies.
16. Nothing in these Terms limits, excludes or modifies, or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law, as well as any other implied warranties under the Australian Consumer Law or similar consumer protection
laws in Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Offer including, but not limited to, where arising out of the following:
a) any technical difficulties or product malfunction (whether or not under the Promoter's
control);
b) any theft, unauthorised access or third party interference;
c) any claim that is late, lost, altered, damaged or misdirected (whether or not after the
receipt by the Promoter) due to interference; or
d) any tax liability incurred by a claimant,
except to the extent that such liability arises as a result of the Promoter's own error, omission or negligence.
17. The Promoter collects personal information (PI) disclosed by an Eligible Claimant in order to conduct the Offer and otherwise for the purposes set out in this clause 19 , and may, for these purposes, disclose an Eligible Claimant’s PI to third parties, including but not limited to the Promoter’s agents, contractors and service providers. The purchase of a Participating Product and claiming the Offer is conditional on that Eligible Claimant providing this PI. In addition to any uses that may be outlined in the Promoter's Privacy Policies, if the Eligible Claimant opts-in by ticking the opt-in box at the time of submitting their claim, that Eligible Claimant consents to the information they submit being entered into a database of the Promoter and its agents and for this
information to be used, unless otherwise advised, for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. All personal details of the Eligible Claimant will be stored by the Promoter and its agents and are subject to the Promoter’s Privacy Policy, see https://kitchenaid.com.au/pages/privacy-policy. A request to opt out, access, update or correct any information can be made by contacting the Promoter. Unless otherwise indicated by the Promoter or its agent, the Promoter or its agent may disclose PI overseas.
18. The Promoter may change these Terms from time to time, by posting the revised Terms (or a link to them) on the Promoter's Website. Eligible Claimants should regularly check the Promoter's Website for any updates.
19. This Offer is subject to availability and may be withdrawn or amended without notice. This Offer cannot be used in conjunction with any other offer. See full terms and conditions below.
20. If you have any dispute or complaint relating to the Offer, please contact the Promoter at the details listed in clause 2 of these Terms. The Promoter will use its reasonable endeavors to respond to you within 21 business days to discuss a resolution in good faith.
21. These Terms and Conditions are governed by the laws of New South Wales. Claimants submit to the non-exclusive jurisdiction of the courts of New South Wales.
