FULL TERMS AND CONDITIONS
The promoter is Al.ive Body PTY LTD (ABN: 37 635 011 960), trading as Al.ive Body, whose registered office is at 539 Goodwood Road, Colonel Light Gardens SA 5041
(Al.ive Body). KitchenAid Australia Pty Ltd (ABN: 50 601 363 419) whose registered office is at 6-8 Billbrooke Close Cameron Park NSW 2286, Australia, telephone
(02) 4902 6500 (KitchenAid) will supply part of the Prize.
WHO MAY ENTER
The Competition is open to residents of Australia and New Zealand only aged 18 years or over, excluding management, directors employees or contractors of Al.ive
Body and KitchenAid, and retailers, suppliers, agencies and companies associated with the Competition, and their close relatives and anyone otherwise connected
with the judging of the Competition (Entrants).
TERMS OF ENTRY
This Competition opens at 9.00 am AEST on Monday 23 June 2025 and closes at 11:59 pm AEST on Monday 30 June 2025 (the Promotion Period). Entries received
outside this period will not be eligible. Submitting an entry constitutes acceptance of these terms and conditions.
Entrants must, during the Promotion Period:
- Follow (or already be following) both of the Instagram accounts: @al.ive_body (located at www.instagram.com/al.ive_body/) and @kitchenaid_ausnz
(located at www.instagram.com/kitchenaidausnz/). - Like the giveaway post that is subject of this Competition, located at both the Promoter's and KitchenAid's Instagram account and posted on Monday 23
June 2025. - Tag a friend in the comments section of the above giveaway post.
- Head to the link in the Promoter's Instagram bio (@al.ive_body) to complete the entry form with their nominated email address and subscribe to
receive the Promoter's newsletters and other marketing communications. - Head to the link in KitchenAid's Instagram bio (@kitchenaidausnz) to subscribe to receive KitchenAid's newsletters and other marketing
communications; - Remain subscribed to receive both the Promoter's and KitchenAid's newsletters and other marketing communalisations until at least the end of the
Promotion Period. (Eligible Entry).
Entrants can enter the Competition multiple times, so long as all of the conditions above are met and each new Eligible Entry includes a new comment that tags a
new friend. Each time an Eligible Entry is submitted, Entrants will be automatically entered into the Competition and will be eligible to win the prize.
The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries or entries not received for any reason. The Promoter are not responsible for technical difficulties with the entry mechanism and do not warrant that the entry mechanism will be available at all times.
The Promoter reserve the right to disqualify entries in the event of non-compliance with these terms and conditions:
- Incomplete, illegible, indecipherable or incorrect entries, or entries containing offensive or defamatory comments, or which breach any law or infringe
any third-party rights (including intellectual property rights) are invalid. - Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way (including by using any automated entry
software), or who does not properly comply with the entry process, will be ineligible to win.

There is only one (1) Prize on offer as part of the Competition. The prize is not transferable or exchangeable for cash. Al.ive Body reserves the right to modify or
cancel the Competition subject to approval of the relevant authorities, and accept no responsibility for any variation in the value of the Prize, or for any tax liabilities
that may arise from winning the Prize. In the event that the Promoter and/or KitchenAid are unable to supply the Prize or any part thereof, the Promoter and/or
KitchenAid reserve the right to supply alternative Prize (or part thereof) of similar monetary value.
SELECTING THE WINNER
This is a game of chance, not skill. The draw will take place at al.ive Body's premises (539 Goodwood Road, Colonel Light Gardens SA 5041) at [9:00pm] AEST on Tuesday, 1 July 2025. A representative of al.ive Body will use an electronic random draw system to randomly select one winner and will verify that it is an Eligible Entry. The Promoter may draw additional reserve entries (and record them in order). In the event of an invalid entry or an ineligible entrant, or if the entrant is ineligible to accept the prize, the prize will be awarded to the first reserve entry drawn. If the prize can’t be awarded to the entrant drawn, the promoter will then continue this process until the prize is awarded.
The winner will be announced on Tuesday 1 July 2025. The winner’s first initial, last name and postcode will be published on Al.ive Body and KitchenAid's Instagram stories (@al.ive_body and @kitchenaid_ausnz) and will be notified by the Promoter in writing via their email address that was used to fill the entry form and subscribe to the Promoter's and KitchenAid's newsletters and other marketing communications by Wednesday 2 July 2025.
If the winner does not claim the Prize within 14 days of the draw (15 July 2025), the Prize will be deemed as forfeited. It is the responsibility of all Entrants to check
their email inboxes to ensure that they receive any communications relating to the Competition.
In the event that a re-draw is required, a representative of al.ive Body will conduct a re-draw on Wednesday 16 July 2025 at the same location and time as the original draw and will notify the unclaimed prize winner in writing within 7 days of the draw. The winners first initial, last name and postcode will be published on Al.ive Body and KitchenAid's Instagram stories (@al.ive_body and @kitchenaid_ausnz) within 7 days of the draw.
The Promoter's decision is final on all matters and no correspondence will be entered into.
The Prize will be delivered by the Promoter and KitchenAid (as stipulated above) to the winner's nominated address (which must be a valid Australian or New Zealand address). All other costs associated with the Prize are the responsibility of the winner. The Promoter and KitchenAid will not be liable for any loss or damage to the prize caused by its delivery to the nominated address. We will never ask for credit card details or sensitive information to claim a prize.
OTHER TERMS AND CONDITIONS
You acknowledge that this Competition is in no way sponsored, endorsed, administered by, or associated with Instagram. You release Instagram from all claims that you may have against Instagram arising out of or in connection with this Competition.
Entrants agree and acknowledge that all Eligible Entries and any intellectual property rights subsisting in and to their
Eligible Entries are and remain the property of the Promoter upon their creation (i.e., entry into the Competition). The Promoter and KitchenAid reserve the right to use any Eligible Entry for any purpose in connection with the Competition and the Prize.
The Promoter and KitchenAid collects personal information about entrants to include entrants in the Competition and where appropriate award a Prize. If the personal information requested is not provided, the entrant cannot participate in the Competition. By participating in the Competition, each Entrant consents to disclosing their personal information to the Promoter and KitchenAid, the Promoter and KitchenAid using, and disclosing their personal information to the relevant authorities in the relevant States, the Promoter's and KitchenAid's related entities, the Promoter's and KitchenAid's agencies and other third parties engaged to provide services in connection with the Competition for the following purposes:
(a) conducting the Competition;
(b) contacting the Entrant in relation to the Competition;
(c) improving the Promoter's, KitchenAid's or their related entities' goods and services;
(d) in the Promoter's case, for the purposes set out in its privacy policy (available at https://alivebody.com.au/policies/privacy-policy); and
(e) in KitchenAid's case, for the purposes set out in its privacy policy (available at https://kitchenaid.com.au/pages/privacy-policy);
Entrants provide this consent until such a time as they withdraw their consent by giving notice to the Promoter. Entrants can also gain access to, update or correct any personal information held by contacting the Promoter at the details listed in these terms and conditions. All personal information will be stored at the offices of the Promoter and KitchenAid.
The Promoter and KitchenAid will not be liable for any loss or damage whatsoever (including but not limited to indirect or consequential loss) or for personal injury
which is suffered or sustained in connection with this Competition or as a result of accepting or using the Prize, except for any liability which cannot be excluded by law.
If the Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of
the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserve the right, in their sole discretion, to the
fullest extent permitted by law:
(a) to disqualify any Entrant; or
(b) subject to any written directions from any applicable regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.
If you have any dispute or complaint relating to the Competition, please contact the Promoter at the details listed in these terms and conditions. The Promoter will use their reasonable endeavours to respond to you within 21 business days to discuss a resolution in good faith.
The Promoter may, subject to approval of the relevant authorities, change these terms and conditions from time to time, by posting the revised terms and conditions (or a link to them) on the Promoter's website. Entrants should regularly check the Promoter's websites for any updates.
