Terms & Conditions
1 Information on how to purchase Participating Products and how to receive a Gift forms part of these Terms and Conditions (Terms). These Terms apply to the KitchenAid Australia Espresso Coffee Gift With Purchase Promotion July 2025 (Promotion) and submission of a claim to redeem a Gift is deemed acceptance of these Terms.
2 The promoter is KitchenAid Australia Pty Ltd (ABN 50 601 363 419) of 6-8 Billbrooke Close, Cameron Park NSW 2285, Australia, telephone (02) 4902 6500 (Promoter).
Definitions
3 For the purposes of these Terms:
a) Participating Product(s) refers to the Tier One Participating Product and/or the Tier Two Participating Product(s). The Participating Products are subject to stock availability.
b) Tier One Participating Product refers to the KitchenAid Semi Automatic Espresso Machine with Burr Grinder, model number KES6551 (RRP $999)
c) Tier Two Participating Product(s) refers to any of the following:
i. KitchenAid Fully Automatic Espresso Machine KF6, model number KES8556 (RRP $1,799);
ii. KitchenAid Fully Automatic Espresso Machine KF7, model number KES8557 (RRP $2,199); or
iii. KitchenAid Fully Automatic Espresso Machine KF8, model number KES8558 (RRP $2,599).
d) Gift refers to the Tier One Gift and/or the Tier Two Gift, as applicable.
e) Tier One Gift refers to:
i. KitchenAid Double Wall Latte Glasses x 2 (RRP $40); and
ii. On-demand video tutorials on how to set up and use the KitchenAid Semi Automatic Espresso Machine with Burr Grinder (X minutes); and
iii. A 15-minute, one-on-one question and answer session with Bel ("Ask an Expert") (booked by appointment via Google Calendar).
f) Tier Two Gift refers to:
i. KitchenAid Double Wall Latte Glasses x 4 (RRP $80); and
ii. On-demand video tutorials on how to use the KitchenAid Fully Automatic Espresso Machine KF6, KF7 or KF8 (approximately 10 minutes); and
iii. A 15-minute "Ask an Expert" session with Bel (booked by appointment via Google Calendar).
Promotion entry details
4 The Promotion will be open from 9:00am AEST on Sunday, 6 July 2025 and will close on 11:59pm AEST on Sunday, 27 July 2025 (Promotion Period). Purchases made outside the Promotion Period are not subject to this Promotion.
5 Entry is open to Australian residents aged 18 years and over (Eligible Claimant(s)).
6 Employees, directors, management and contractors of the Promoter and other agencies, firms, retail staff or companies associated with the Promotion, and their immediate families, are not eligible to enter. By entering this Promotion you represent that you are eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
How to enter the Promotion
7 To enter the Promotion and be eligible for the Gift, the Eligible Claimant must, during the Promotion Period, purchase a Participating Product online at kitchenaid.com.au (Website).
8 Eligible Claimants who purchase a Tier One Participating Product will be eligible for the Tier One Gift. Eligible Claimants who purchase a Tier Two Participating Product will be eligible for the Tier Two Gift.
9 When purchasing a Participating Product from the Website, the Eligible Claimant must follow the following steps in order to receive the Gift:
a) Complete the purchase of the Participating Product on the Website during the Promotion Period and opt in to receive updates and marketing communications from the Promoter at checkout (by ticking the applicable box at check out). The Eligible Claimant will then receive an order confirmation email from the Promoter;
b) If the Eligible Claimant has correctly opted in to receive updates and marketing communications from the Promoter (per clause 9a above), the Eligible Claimant will receive an email within 2 business days containing a link to access the on-demand video tutorials and book a 15-minute "Ask an Expert" session with Bel (via Google Calander) (the Gift Email).
c) It is the Eligible Claimant's responsibility to book a 15-minute "Ask an Expert" session with Bel via Google Calendar. The available dates and times for the "Ask an Expert" sessions are as follows and may be subject to change:
a. Monday 14th July 4PM-6PM AEST
b. Wednesday 16th July 11AM-1PM AEST
c. Monday 28th July 4PM-6PM AEST
d. Tuesday 29th July 10AM-12PM
e. Tuesday 12th August 11AM-1PM
f. Thursday 14th August 5PM-7PM
In booking an "Ask an Expert" session, the Eligible Claimant must provide its name, email address, phone number and details of its KitchenAid Espresso Machine (and, optionally, any their questions for Bel).
The "Ask an Expert" session must be redeemed during the above times. The Promoter is not responsible if the Eligible Claimant fails to do so or loses the Gift Email.
d) The on-demand video tutorials are pre-recorded [X] minute videos presented by Bel and are available to view at any time. The Eligible Claimant will have access to view the video tutorials relevant to their KitchenAid Espresso Machine.
e) The KitchenAid Double Wall Latte Glasses will be delivered from the Promoter to the Eligible Claimant to the address nominated by the Eligible Claimant when purchasing the Participating Product.
10 A maximum of one (1) Gift can be redeemed per Eligible Claimant.
11 The Promoter reserves the right to disqualify Eligible Claimants if proof of age or identity has not been provided, or the Eligible Claimant has not otherwise complied with these Terms. The Promoter's decision is final on all matters and no correspondence will be entered into.
12 The Promotion is not available in conjunction with any other promotion, offer or discount unless otherwise specified.
Participating Product and Gift details
13 Commercial sales, second-hand purchases, refurbished products, trade seconds products, insurance claims, purchases denoted “Clearance” (including seconds) or special offers are excluded from this Promotion, and any Participating Products purchased in these ways will not be eligible for this Promotion or the Gift.
14 Should the Gift or any part of the Gift become out of stock, the Promoter reserves the right to provide an alternative item of the same or higher retail value. The Gift is not transferable or exchangeable by the Eligible Claimant. All other costs associated with the Gift are the responsibility of the Eligible Claimant.
15 The Eligible Claimant must not distribute the link to, or otherwise provide access to, the on-demand video tutorials or the "Ask an Expert" session to any third party.
16 The Eligible Claimant shall accept the Gift as described in these Terms and acknowledges that the Promoter accepts no responsibility for any variation in value, or for any tax liabilities that may arise from claiming the Gift. The Recommended Retail Price (RRP) includes GST and is suggested only.
17 Any costs incurred by the Eligible Claimant associated with this Promotion including making telephone enquiries in relation to the Gift are the sole responsibility of the Eligible Claimant.
Other Terms
18 Nothing in these Terms limits, excludes or modifies, or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law, as well as any other implied warranties under the Australian Consumer Law or similar consumer protection laws in Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion including, but not limited to, where arising out of the following:
a) any technical difficulties or product malfunction (whether or not under the Promoter's control);
b) any theft, unauthorised access or third party interference;
c) any claim that is late, lost, altered, damaged or misdirected (whether or not after the receipt by the Promoter) due to interference;
d) any tax liability incurred by a claimant; or
e) use of the Gift,
except to the extent that such liability arises as a result of the Promoter's own error, omission or negligence.
19 The Promoter collects personal information (PI) disclosed by an Eligible Claimant in order to conduct the Promotion and otherwise for the purposes set out in this clause 18, and may, for these purposes, disclose an Eligible Claimant’s PI to third parties, including but not limited to the Promoter’s agents, contractors and service providers. The purchase of a Participating Product and claim for a Gift is conditional on that Eligible Claimant providing this PI. In addition to any uses that may be outlined in the Promoter's Privacy Policies, if the Eligible Claimant opts-in by ticking the opt-in box at the time of submitting their claim, that Eligible Claimant consents to the information they submit being entered into a database of the Promoter and its agents and for this information to be used, unless otherwise advised, for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. All personal details of the Eligible Claimant will be stored by the Promoter and its agents and are subject to the Promoter’s Privacy Policy, see https://kitchenaid.com.au/pages/privacy-policy. A request to opt out, access, update or correct any information can be made by contacting the Promoter. Unless otherwise indicated by the Promoter or its agent, the Promoter or its agent may disclose PI overseas.
20 The Promoter may change these Terms from time to time, by posting the revised Terms (or a link to them) on the Promoter's Website. Eligible Claimants should regularly check the Promoter's Website for any updates.
21 If you have any dispute or complaint relating to the Promotion, please contact the Promoter at the details listed in clause 2 of these Terms. The Promoter will use its reasonable endeavors to respond to you within 21 business days to discuss a resolution in good faith.
